These Terms govern the use of andesvivienda.com and the interaction with Andesvivienda S.A. (RUC 1793215487001). By using this site you accept these Terms and the Privacy Policy.
1. Scope of the site
This site provides information about the private participation program in housing developments. It does not constitute a public offering of securities nor financial advice within the meaning of the Ecuadorian Codification of Monetary, Financial, Securities and Insurance Resolutions.
2. Eligibility
The program is directed exclusively to Ecuadorian citizens aged between 40 and 65 at the time of consultation. Definitive conditions are always formalized through a written contract per project.
3. Nature of the participation
Participation in each project is instrumented through participation association contracts (Art. 423 and following of the Ecuadorian Commercial Code). Returns depend on the actual construction progress and final commercialization. There is no capital guarantee.
4. Risks
Participation involves risks including, without limitation: construction delays, real estate market fluctuations, macroeconomic conditions, regulatory risk and partial or total loss of the contributed capital. Historical results do not ensure future results.
5. Permitted use of the site
It is prohibited to: (a) attempt unauthorized access to the systems; (b) use aggressive automated scraping; (c) impersonate identity; (d) publish content through the form that is unlawful, defamatory or discriminatory. We may suspend access in the event of non-compliance.
6. Intellectual property
Texts, images, the ‘Andesvivienda’ brand and the logo are the property of Andesvivienda S.A. or its licensors. Personal and non-commercial viewing is authorized. Any other use requires written authorization.
7. External links
We may include links to third-party sites for informational purposes. We are not responsible for their content, accuracy or privacy policies.
8. Limitation of liability
Andesvivienda is not liable for indirect damages, loss of profit or loss of opportunity arising from the use of the site, except in cases of willful misconduct or gross negligence. Our maximum liability is limited to the amounts effectively paid by the user under the corresponding contractual framework.
9. Amendments
We may update these Terms at any time. We will publish the current version on this page with its effective date. Continued use after publication constitutes acceptance of the new version.
10. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Ecuador. Any dispute shall be submitted to the competent judges of the Metropolitan District of Quito, with express waiver of any other forum, except for non-waivable consumer rights.
